General Term and Conditions

Rosenschule - Stange    -   Terms and Conditions

Guarantee - All plants are guaranteed. Notices of failure should be in writing no later than the 31st July in the summer following delivery. Free of charge replacements will normally be sent during November and December.

Placing Orders - We accept orders for bare root roses from 1st April each year to 31st March the following year, for despatch between late October and April. Orders are sent out in strict numerical sequence, according to the date on which they were received. Soon after ordering customers will receive an acknowledgement with an Order Number which should be quoted in all communications concerning the order.

Lifting and Despatch - The roses we supply do not lend themselves readily to mechanisation. Our lifting season extends from mid October until the end of April. We regret we are unable to notify customers, in advance, of despatch dates for their orders. Orders placed before the end of September will usually be despatched by the end of November. Orders placed in October and November, are sent in December.Orders placed in December and January, are sent in February and orders placed during February and March will be sent out during March. Orders placed during the second half of November could arrive just before Christmas. Please note that severe weather conditions can make lifting impossible and delays may occur. If you have any specific requests concerning the timing of your delivery, please let us know. It is not usually possible for us to bring forward delivery dates, but we can delay the despatch of your order from the normal run.

Substitutes and Held Over Roses - As we offer over 450 varieties of roses, and they take 2 years to produce, it is not always possible to predict precisely how many of a particular variety will be sold during a season. To cover this eventuality, we ask you to list the names of substitutes you would accept in place of any roses on your order which are out of stock. If you do not select substitutes, they will automatically be sent to you, unless we are instructed to hold over your original choice until the next season. (See box on order form).

Carriage and Packing Charges - Add 16. These rates apply to U.K. For Eire and Channel Islands and other Countries outside the UK please see separate, enclosed delivery schedule.

Payment for Bare Root Roses - Full payment is due when orders are placed. Acknowledgments will be issued shortly after orders are received. Cheques should be made payable to Rosenschule - Stange. In case of payment by debit or credit card and pay pal your account will be debited when your order is received.

Prices - Note: The prices in this catalogue are for bare root plants. Container roses may be more expensive.

Collection - Roses can be collected between the end of October and the end of March. Having placed an order and paid a non-refundable 20% deposit, please advise us of your intended collection date, at least three clear working days (Mon-Fri) before that date. This enables the nursery staff to lift and package orders and prepare the necessary paperwork.

Cancellations - Any order cancelled more than 14 days from date of receipt will be subject to a 20% cancellation charge.

Standard Tree Roses - Cannot be sent to destinations outside the German mainland.

Export Delivery Charges - Please read carefully the separate sheet enclosed which gives full details of delivery charges to your Country.

Payment of Export Orders - Payment will only be accepted in Euro by way of Bank Transfer, Mastercard, Visa, Access or Switch/Maestro and Pay Pal. Payment is due when orders are placed and roses will not be despatched until full payment has been received.

E.U. Export Orders - No import restrictions and no surcharges needed.

Export Outside E.U. - A charge of 10% of the rose value will be added when root washing procedures are necessary. A surcharge of 20.00 per order will be applied to cover statutory export administration charges. Overseas customers should check with their Government Agricultural Department to see if an import permit is required, if so a copy of this should be sent with the order. Our Ministry of Agriculture Plant Inspectors are unable to release the plants without sight of these documents.

Excluded Countries - As a result of restrictive import regulations imposed we are not able to export our roses to Australia, New Zealand or South Africa.

Guarantee & Non-availability of Exported Roses - We will honour our guarantee terms on any roses which fail to grow and will hold over roses for delivery the following season, but all other costs viz. root washing, carriage, packing and statutory export charges will be applied to any replacements or hold over roses sent.

Quality - All our stock is of the best possible quality for the particular variety, but it should be noted that although most shrubs, old-fashioned and climbing roses etc. make quite good sized saleable plants, some, especially the rare varieties, tend to be much smaller and it is often for this reason that many old roses are not widely grown by other nurseries. Thus if you order these, you must accept that the rarer sorts may be smaller than their more vigourous counterparts. In other words their price relates to the rarity and degree of difficulty to produce rather than the size of the plant. We therefore reserve the right to send the best plant we have of any given variety. If, in our judgement, we consider it to be smaller in size than you might reasonably expect, we will attach a label indicating this fact and undertake to replace it the following year if it fails to attain a good size. 2. Confirmation of order and cancellation

Orders from our online shop will be confirmed by automatic email. Please keep a copy of this email receipt and your order number in case of any queries. You may cancel your order at any time without penalty provided that the order has not already been dispatched. See note 8 below on our returns policy.

3. Stock availability

We try to ensure that all products listed on our website are in stock and available. If when processing your order we find that an item is out of stock, we will contact you as soon as possible by email to let you know whether the item will be restocked and when it will be available.

4. Descriptions of products

While we take every care to ensure the accuracy of descriptions we make no representations or warranties with regard to the products offered. This includes the accuracy or completeness of the information, or the merchantability or fitness for purpose of the products.

5. Payment

We can only accept payment by debit or credit card (most major cards accepted except American Express and Diners Club),Pay Pal and Bank transfer. Payments will be taken when the order is ready to dispatch.

6. Delivery

UK mainland 16,00

Europe: 1-8 items 16,00

9 items and above 25,00

Separate charges are applicable for the delivery of roses and garden plants.

We aim to dispatch your order by DHL within 7 working days of receipt. In the case that your order may be delayed if items are out of stock we will notify you as soon as possible by email.

7. Overseas delivery

For orders shipped to overseas addresses, the recipient is responsible for any local import duties and taxes payable. We regret that we are unable to ship to addresses outside of the EU at present, and we cannot ship any pesticides, herbicides, fungicides or fertilisers to addresses outside of Germany

8. Returns and exchanges

If you are not entirely satisfied with your purchase you may return it in its original condition to us at your own cost within 30 days of receipt provided that any seals or shrink-wrapping are intact. We will refund you the full cost of the product, excluding any carriage charges. We can only accept the return of items which have been opened if they are faulty.

If the products received are defective or damaged we will exchange them if the item is still available in stock, or refund if it is not available.

Please contact us for advice before returning any goods, quoting the order reference number.

Our returns policy does not affect your statutory rights.

9. Safety information

All pesticides, herbicides and fertilisers come with full instructions on their use and storage, and information on personal and environmental hazards. Please read and follow all instructions printed on the packet. Always keep garden chemicals away from children and pets.
